Terms and Conditions of Sale and Supply

These Terms and Conditions govern the sale of all goods and services supplied by Jordan Acoustics Ltd (“Jordan Acoustics”, “we”, “us” or “our”). By placing an order with us, you agree to be bound by these Terms.
1. Definitions
In these Terms:
- Business Customer means a customer purchasing goods or services wholly or mainly for business, trade or professional purposes.
- Consumer means an individual purchasing goods or services wholly or mainly for personal use.
- Contract means the agreement between you and Jordan Acoustics for the supply of goods and/or services.
- Goods means all products supplied by Jordan Acoustics.
- Services means any installation, delivery, demonstration, commissioning, consultancy or other services supplied by Jordan Acoustics.
- Special Order Goods means products ordered specifically for you, customised to your requirements or not normally held in stock.
- Working Day means Monday to Friday excluding public holidays in England.
- “You” and “your” means the person or organisation purchasing goods or services from us.
These Terms apply to all Contracts unless otherwise agreed by us in writing.
2. Orders and Contract Formation
2.1 Placing an Order
Orders may be placed in-store, by telephone, by email or through our website.
By placing an order you confirm that you are legally entitled to enter into a binding contract.
2.2 Acceptance of Orders
All orders are subject to acceptance by Jordan Acoustics.
A Contract is formed only when we:
- accept your order in writing (including by email);
- dispatch the Goods; or
- begin supplying the Services,
whichever occurs first.
2.3 Product Information
Product descriptions, photographs, demonstrations, specifications, brochures and quotations are provided for guidance only.
Manufacturers may change specifications, finishes or features without notice and minor variations shall not constitute a defect.
2.4 Availability
All Goods are offered subject to availability.
If we cannot supply your order we will notify you promptly and refund any payment already received.
2.5 Pricing Errors
Whilst every effort is made to ensure prices are accurate, genuine pricing or typographical errors may occasionally occur.
Where an obvious error has been made, we reserve the right to cancel the order before the Contract is formed and refund any monies paid.
2.6 Deposits
We may require a deposit for Special Order Goods, made-to-order products or other high-value purchases.
Where we have already committed to purchasing or manufacturing Goods specifically for you, deposits may be non-refundable. This will always be made clear before your order is accepted.
2.7 Changes to Orders
If you request changes after your order has been accepted, we will make reasonable efforts to accommodate them.
However, once Goods have been ordered from the manufacturer or prepared for dispatch, amendments or cancellations may not be possible.
2.8 Finance Purchases
Where Goods are purchased using finance, the Contract remains subject to approval by the finance provider and compliance with their terms and conditions.
2.9 Right to Refuse Orders
We reserve the right to refuse or cancel any order where:
- Goods are unavailable;
- payment cannot be authorised;
- fraudulent or unlawful activity is suspected;
- incorrect pricing has occurred; or
- we reasonably believe we are unable to fulfil the order.
Where payment has already been received, a full refund will be issued.
3. Products, Prices and Payment
3.1 Product Information
We take reasonable care to ensure that product descriptions, specifications, images and prices are accurate at the time of publication. However, manufacturers may change specifications, finishes, dimensions or features without prior notice.
Images, colours and finishes are provided for illustration only. Natural materials such as wood, leather and stone may vary in appearance.
3.2 Product Compatibility
You are responsible for ensuring that the Goods are suitable for your intended application and compatible with your existing equipment, network or installation.
Any recommendations we provide are given in good faith based on the information available at the time. We are not responsible where incompatibility arises from equipment or systems not supplied by Jordan Acoustics unless we have expressly confirmed compatibility in writing.
3.3 Software and Streaming Services
Some products rely upon third-party software, apps or streaming services. Their availability, functionality and features are controlled by the relevant provider and may change without notice.
Manufacturers may also release firmware or software updates which alter product functionality. Jordan Acoustics is not responsible for changes introduced by third parties or manufacturers after purchase.
3.4 Special Order Goods
Special Order Goods are purchased or manufactured specifically for you and may not be cancelled or returned unless faulty or otherwise required by law.
Please check all specifications, finishes and model numbers carefully before confirming your order.
3.5 Prices
Unless stated otherwise, all prices are shown in Pounds Sterling (£) and include VAT at the applicable rate.
Delivery, installation or other optional services will be charged separately where applicable and confirmed before your order is accepted.
3.6 Payment
Payment must be made using one of our accepted payment methods.
Unless otherwise agreed in writing, payment in full is required before Goods are dispatched or collected.
Business Customers must pay invoices by the agreed due date.
3.7 Ownership and Risk
Ownership of the Goods remains with Jordan Acoustics until we have received payment in full.
Risk passes to you when the Goods are delivered to, or collected by, you or a person authorised by you.
3.8 Refunds
Where a refund is due, it will normally be made using the original payment method within the timescales required by applicable law.
4. Delivery, Installation, Returns and Warranties
4.1 Delivery
We will use reasonable endeavours to deliver your Goods within the estimated timescale provided. Delivery dates are estimates only and are not guaranteed.
Delivery charges, where applicable, will be confirmed before your order is accepted.
4.2 Delivery Requirements
You are responsible for ensuring that:
- the delivery address is correct;
- suitable access is available for delivery and installation;
- any necessary electrical supplies, network connections and site preparation have been completed.
Where additional labour, specialist equipment or repeat visits are required due to insufficient access or incorrect information, we reserve the right to make a reasonable additional charge, which will be discussed with you beforehand.
4.3 Inspection
You should inspect the Goods as soon as reasonably practicable after delivery and notify us without undue delay if they are damaged, incomplete or incorrect.
4.4 Installation
Where installation is included, we will carry out the Services with reasonable care and skill.
We may postpone or suspend installation where conditions are unsafe, unsuitable or beyond our reasonable control.
4.5 Consumer Cancellation Rights
If you are a Consumer and purchase Goods online, by telephone or by email, you may cancel your Contract within 14 days of receiving the Goods in accordance with the Consumer Contracts Regulations 2013.
To exercise this right, you must notify us before the cancellation period expires.
Returned Goods should be in immaculate, as-new condition complete with all original packaging, accessories and user manual. You are responsible for any reduction in value resulting from handling beyond what is reasonably necessary.
4.6 Exceptions
The statutory right to cancel does not apply to:
- Special Order Goods;
- personalised or customised products;
- Goods purchased in-store
4.7 Faulty Goods
If Goods are faulty, damaged or not as described, please contact us promptly.
We may inspect, test or return the Goods to the manufacturer before providing a repair, replacement or refund where appropriate.
Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015.
4.8 Manufacturer Warranties
Many products include a manufacturer’s warranty in addition to your statutory rights.
Manufacturer warranties are provided by the manufacturer and are subject to their own terms and conditions. They are in addition to, and do not affect, your statutory rights.
4.9 Returns
Unless Goods are faulty or you are exercising your statutory cancellation rights, you are responsible for the reasonable cost of returning them.
You must retain the original packaging. Returned Goods not sent in the original manufacturers packaging will be declined.
We may, entirely at our discretion, accept returns outside your statutory rights under our goodwill returns policy.
4.10 Events Beyond Our Control
We shall not be liable for delays caused by circumstances beyond our reasonable control, including supplier delays, transport disruption, severe weather, industrial action, government action or failures of third-party services.
5. Demonstration Equipment, Trade-ins and Premium Audio
5.1 Demonstrations
Jordan Acoustics may offer in-store demonstrations, home demonstrations, ex-demonstration products, pre-owned equipment and loan equipment. Availability varies by product.
Any demonstration or loan equipment remains our property and must be returned in the same condition in which it was supplied, allowing for reasonable wear from normal use.
You are responsible for any loss or damage occurring while demonstration or loan equipment is in your possession, other than fair wear and tear.
5.2 Trade-ins
Trade-in valuations are based upon the condition, age, completeness and current market value of the equipment at the time of inspection.
By offering equipment for trade-in you confirm that you are its legal owner, that it is free from finance or third-party claims and that you have the legal right to dispose of it.
Once a trade-in has been accepted and the transaction completed, ownership transfers to Jordan Acoustics. You also warrant that all personal data has been removed from any equipment capable of storing information.
5.3 Ex-Demonstration and Pre-Owned Equipment
Ex-demonstration and pre-owned products may show signs of previous use. Their condition, accessories and any applicable warranty will be explained before purchase.
5.4 Premium Audio Products
The performance of high-end audio equipment depends upon many factors, including associated equipment, room acoustics, installation, source material and personal listening preference.
Any recommendations provided by Jordan Acoustics are offered in good faith based upon our experience, should be regarded as recommendations only and do not constitute a guarantee of performance or customer satisfaction.
Where possible, we recommend customers arrange a demonstration before purchasing high-value audio equipment.
6. Liability, General Legal Terms and Contact Details
6.1 Liability
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or any liability which cannot lawfully be excluded.
Subject to the above, our total liability arising from any Contract shall not exceed the amount paid by you for the Goods or Services giving rise to the claim.
We shall not be liable for indirect or consequential loss, loss of profit, business interruption or loss of data where such exclusions are permitted by law. Nothing in these Terms limits or excludes your statutory rights as a Consumer.
6.2 Website
All content published on our website, including text, photographs, graphics and logos, remains our intellectual property or that of our licensors and may not be reproduced without permission.
Whilst we make reasonable efforts to ensure that website information is accurate, specifications, pricing and availability may change without notice.
Links to third-party websites are provided for convenience only and we accept no responsibility for their content or operation.
6.3 Privacy
We process personal information in accordance with applicable UK data protection legislation. Details of how we collect and use personal information are contained within our Privacy Policy.
If you have chosen to receive marketing communications, you may unsubscribe at any time.
6.4 General
These Terms constitute the entire agreement between you and Jordan Acoustics regarding the supply of Goods and Services.
If any provision is found to be invalid or unenforceable, the remaining provisions shall continue in full force.
A delay or failure by either party to enforce any right shall not constitute a waiver of that right.
No person other than the parties to the Contract shall have any right to enforce these Terms under the Contracts (Rights of Third Parties) Act 1999.
We may update these Terms from time to time. The version in force when your Contract is formed will apply.
These Terms are governed by the laws of England and Wales. Consumers may also bring proceedings in the courts of the part of the United Kingdom in which they ordinarily reside where applicable.
